Terms & Conditions

Welcome to Focca (focca.co.nz). These Terms & Conditions govern your use of our website and the purchase of our products. By placing an order with us, you agree to be bound by these terms.

1. Ordering & Lead Times

Due to the fresh, handcrafted nature of our products, we operate on a strict pre-order system:

  • 3-Business Day Rule: All orders must be placed at least three (3) business days prior to the requested delivery or collection date.

  • Order Cut-off: For example, orders for a Friday delivery must be finalised and paid for by Wednesday night (11:00 PM).

  • Availability: Orders are subject to production capacity. We reserve the right to close ordering dates early if we reach maximum capacity.

2. No Changes & No Refunds

Because we source fresh ingredients and bake our focaccia specifically for your order:

  • Final Sale: Once the 3-business day cut-off has passed, your order is considered "in production." At this point, no changes to the order (items, quantities, or delivery details) can be made.

  • Cancellations: We do not offer refunds or credits for cancellations made after the cut-off period.

  • Missed Pickups/Deliveries: If you are not present to receive your delivery or fail to collect your order at the specified time and location, and we cannot contact you because of an incorrect or unanswered phone number, the product will be disposed of for food safety reasons, and no refunds or redeliveries will be provided.

3. Products & Allergens

  • Freshness: Our sandwiches are made with fresh, natural ingredients and our own handcrafted bread. They are intended for consumption on the day of delivery/collection.

  • Allergens: While we take care to prevent cross-contamination, our kitchen handles gluten, dairy, nuts, and other allergens. If you have a severe allergy, please contact us at team@focca.co.nz before ordering.

  • Variations: As our products are handmade and use seasonal produce, slight variations in appearance or ingredients may occur.

4. Pricing & Payment

  • All prices are in New Zealand Dollars (NZD) and include GST unless otherwise stated.

  • Full payment is required at the time of ordering via our secure online checkout. Your order is not confirmed until payment is received.

5. Delivery

  • Deliveries will be made to the designated drop-off point or department specified at the top of the ordering page.

  • It is the customer’s responsibility to provide accurate delivery instructions. We cannot be held responsible for delays caused by restricted access or incorrect contact information.

6. Limitation of Liability

To the extent permitted by New Zealand law (including the Consumer Guarantees Act), Focca shall not be liable for any indirect or consequential loss arising from a delay in delivery or the unavailability of specific products. Our total liability is limited to the purchase price of the goods ordered.

7. Governing Law

These terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.
